These terms of service ("Terms") govern your use of the Tarifoo food delivery marketplace at tarifoo.com. By using our service, you agree to these Terms. Please read them carefully.
Acceptance of Terms
By accessing or using Tarifoo, you confirm that you are at least 16 years old and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our service.
Our Service
Tarifoo is a food delivery marketplace that connects customers with local restaurants in Tarifa, Spain. We facilitate orders and arrange delivery through independent drivers. Tarifoo acts as an intermediary — we are not the seller of the food, nor do we prepare it. Each restaurant is responsible for the quality and safety of its food.
User Accounts
You may place orders as a guest or by creating an account. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate and complete information and keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent activity.
Orders and Payments
Menu prices are set by each restaurant and displayed inclusive of applicable taxes. A delivery fee may apply depending on your delivery zone. The total amount is shown before you confirm your order. Payments are processed securely through Mollie. We accept card payments and cash on delivery where available. By placing an order, you authorise us to charge your selected payment method for the total amount. Once confirmed by the restaurant, your order is binding. Price errors will be handled on a case-by-case basis.
Delivery
Estimated delivery times are provided for convenience and are not guaranteed. Actual delivery times may vary due to restaurant preparation, driver availability, traffic, and weather conditions. You must provide an accurate delivery address and be available to receive your order. If a delivery cannot be completed because you are unreachable, the order may not be refunded.
Phone Number Sharing
By placing an order for delivery, you consent to your phone number being shared with the assigned delivery driver for the purpose of coordinating your delivery. The driver's phone number will also be shared with you. This sharing is limited to the duration of the active delivery.
Cancellation and Refunds
You may cancel an order before the restaurant confirms it. Once a restaurant has begun preparing your food, cancellation may not be possible. Refunds for card payments are processed through Mollie and typically appear within 5–10 business days. Cash orders that are cancelled before preparation will not be charged. If you receive an incorrect or incomplete order, please contact us through the app within 24 hours and we will arrange a refund or replacement.
Acceptable Use
You agree not to: • Use the service for any unlawful purpose • Submit false or misleading information • Harass or abuse restaurant staff, drivers, or other users • Attempt to circumvent payment or delivery fees • Interfere with the operation of the platform We reserve the right to refuse service to anyone who violates these guidelines.
Limitation of Liability
Tarifoo provides the platform on an "as is" basis. To the maximum extent permitted by law, we are not liable for: • Food quality, safety, or allergen issues (restaurant responsibility) • Delivery delays beyond our reasonable control • Losses arising from unauthorised access to your account • Indirect, incidental, or consequential damages Nothing in these Terms excludes or limits our liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
Governing Law
These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms shall be submitted to the courts of Cádiz, Spain, without prejudice to any mandatory consumer protection provisions that may apply.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
